Public Law / Care and Adoption Proceedings
During pupillage, Elicia gained considerable knowledge and experience in all areas of public children law. She has experience in drafting case summaries and position statements, and has been commended with her efficient submission of draft orders in public children work.
Elicia is looking forward to expanding her practice in public children work, and accepts instructions from any party at short notice for urgent hearings such as EPO’s and ICO’s.
Elicia has a calm demeanour and is able to build an empathetic rapport with clients which assists in dealing with these sensitive matters.
Private Law Children: Contact and Residence disputes under the Children Act 1989
Elicia frequently represents applicants and respondents in applications made under Section 8 of the Children Act 1989. Elicia has significant experience in applications for Child Arrangements Orders, Prohibited Steps Orders, Specific Issue Orders and Special Guardianship Orders.
Elicia has represented clients from initial hearings through to contested final hearings. This includes matters involving domestic abuse, vulnerable parties, allegations of parental alienation, and those which have required the involvement of the Local Authority and/or Children’s Guardians.
As well as representing parents, Elicia also has experience in representing children through their Guardians under 16.4 of the Family Procedure Rules.
Elicia is able to use her extensive knowledge of immigration law to assist clients in private children matters where the immigration status of a party or child is a key feature in proceedings.
In her role a Director of Lawyers in the Soup Kitchen, Elicia gained a wealth of experience in Private Law child contact proceedings. She regularly instructed counsel, drafted position and witness statements, alongside creating hearing bundles.
Domestic violence & injunctions
Elicia regularly represents both applicants and respondents who are involved in Family Law Act 1996 proceedings. She has extensive experience in applications for non-molestation orders and occupation orders, including where those applications are linked to Children Act 1989 proceedings. Elicia receives instructions on both ex-parte and on-notice applications.
Family: Finance
Elicia is regularly instructed on a variety of financial remedies proceedings including First Hearing Appointments, Financial Dispute Appointments, Final Hearings and applications for the enforcement of financial remedy orders.
Immigration
Prior to coming to the Bar, Elicia gained extensive experience at the First Tier Immigration Tribunal in all areas of Immigration law, including asylum, deportation, human rights and EU settlement scheme appeals in her role as a Presenting Officer acting on behalf of the Secretary of State for the Home Department.
In March 2022, whilst at the Home Office, Elicia completed a secondment to the Windrush Lessons Learned Review Revisit Team as a Senior Policy Advisor in which she assisted in assessing the implementation of the 30 recommendations by the Home Office in the initial Windrush Lessons Learned Review.
Elicia is keen to develop a practice in the area of immigration and has fund her knowledge useful in both public and private law children’s proceedings where issues may arise concerning the status of parents and children alike.
